The supplication of Lazarus who is confronting a two-tally charge of rape and assault was not taken on account of the idea of the offenses.
Boss Magistrate Tajudeen Elias, requested that the blamed be remanded in Ikoyi Prison, pending guidance from the Department of Public Prosecutions (DPP) and dismissed the case until Oct. 19
The prosecutor, Sgt. Hafsat Ajibode had told the court that the blamed submitted the charged offenses here and there in July at No. 34, Surulere St., Oworonsoki, Lagos.
She affirmed that the blamed had coitus for the minor on two events.
"The blamed's sister and the young lady's moms are companions and neighbors; the mother left her in the care of her companion when she went to the market.
"The denounced's sister who needed to purchase something outside the compound, left the young lady and her six-year-old sibling in the room while they were watching toon on her telephone.
"The denounced who lives with his sister saw her going out and utilized the chance to sexually struck her.
"The six-year-old kid who the denounced thought was too little to comprehend what occurred, was the one that revealed the end result for their mom.
"Your respect, the medicinal report indicated confirmation of entrance," she said.
The offenses contradicted Sections 137 and 263 of the Criminal Law of Lagos State, 2015 (Revised)
As per Section 137, "Any individual who has unlawful sex with a kid is blameworthy of a crime, and is at risk to detainment forever."
Segment 263 conveys five years detainment for wrongdoers.
