Court Adjourns Melaye’s Bail Application Till May 16

The Chief Justice, Nasiru Ajanah, adjourned the case after listening to arguments from both the prosecuting counsel, Dr Alex Iziyon (SAN) and the defense counsel, Chief Mike Ozekhome (SAN).
At the last sitting, Justice Ajanah had adjourned the case as a result of the failure of the lawyers of the Police and Senator Melaye to file their affidavit on the bail application.

The embattled senator, who is currently on admission at the national hospital in Abuja was remanded in police custody by the same court over alleged unlawful possession of arms alongside two others in Kogi State.

He was arrested on April 24 after police laid siege to his house in Abuja.
However, he landed in the hospital after he sustained injuries as he allegedly jumped from a moving vehicle which was conveying him to Kogi State to be arraigned before the court.

On May 4, the senator appeared before a Senior Magistrates Court in Kogi state, on a stretcher.
The prosecution counsel, however, argued that the court did not have the jurisdiction to entertain the case.

But Melaye’s lawyer in his submission argued that the court had the power by virtue of the Constitution to try the case.

Furthermore, he quoted Section 97 of the Penal Code which stated that the offence of conspiracy is bailable according to the Kogi State Administration of Criminal Justice.

He also presented two medical reports from the national hospital which stated that Melaye is bedridden owing to a spinal chord injury he sustained after he jumped out of a moving police.

After a short recess, however, Chief Magistrate Suleiman Abdulahi denied the bail application and ruled that Melaye would remain in custody for the next 39 days.

Subsequently, the hearing for bail was fixed for May 7 but has been adjourned for the third time since then.
