Senate Pays Senator Dariye N85.5m Allowances Even While In Prison

A half year after his conviction by a Federal Capital Territory High Court, Senator Joshua Dariye is as yet accepting the N750, 000 compensation and N13.5m month to month running expense from the National Assembly, The PUNCH can report.

Examinations by The PUNCH uncovered that Dariye, who speaks to Plateau-Central Senatorial District, was all the while getting the stipends since his seat presently couldn't seem to be proclaimed empty by the initiative of the National Assembly.

Dariye, who was legislative head of Plateau State from 1999 to 2007, was indicted by the Economic and Financial Crimes Commission and sentenced by Justice Adebukola Banjoko of an FCT High Court for stealing N1.162bn.

He was accordingly condemned to 14 years in jail, however, his sentence was diminished to 10 years by the Court of Appeal which maintained his conviction a month ago.

The ex-senator had even made a non-refundable installment of N8m for the All Progressives Congress' Senate shapes yet was screened out by the gathering in September.

Talking with The PUNCH on the phone, an assistant to Dariye, Mr. Christopher John, said the convict and his helpers were all the while getting their full recompenses.

He said Dariye had bid his conviction at the Supreme Court and it would be uncalled for his seat to be proclaimed empty when he had not yet abused every legitimate channel.

John stated, "He has just advanced the case; so he is as yet a congressperson pending the choice of the Supreme Court.

"It is ideal for us to in any case be getting pay rates since his case has not finished.

There are numerous different representatives having issues with the courts like Senator Attah Idoko from Kogi State.

Judgment was given for AVM Isaac Alfa yet since Idoko has claimed the case, he is as yet serving and going to sittings as a representative pending the result of the case.

"Assistants should, in any case, be accepting compensation in light of the fact that Dariye is as yet a representative. Furthermore, he is as yet accepting his stipends and will keep on doing as such until the point that the case is shut."

Likewise talking with our reporter, the Special Adviser to the Senate President on Media, Yusuph Olaniyonu, said he couldn't affirm if Dariye was all the while accepting stipends or not.

Olaniyonu, be that as it may, said the previous senator's seat couldn't be announced empty until the authority of the Senate got official correspondence from the Office of the Attorney General of the Federation.

Whenever inquired as to whether the Senate didn't know about the exceedingly advanced conviction of Dariye, Olaniyonu said the administrative arm of government does not act dependent on media reports but rather on authority correspondence.

He stated, "The Senate President has no capacity to proclaim any seat empty aside from he is given a demand. We need to get official correspondence from the individuals who indicted him. We can't peruse a report in the papers and proceed to proclaim his seat empty.

"Regardless of whether a representative bites the dust, his family would illuminate the authority of the Senate or congresspersons would go and pay a sympathy visit and formally affirm that he is dead and after that the Independent National Electoral Commission will be informed that the seat is empty.

"The individuals who indicted Senator Dariye never educated us that he had been sentenced. Truth be told, we even perused that he purchased the APC ticket to challenge for re-appointment. The AGF arraigned him and he should compose the Senate with the goal that the seat can be announced empty and another decision led."

However, the Director for Information at the National Assembly, Mr Jerry Agada, said there was no court request or order from the Senate President to stop Dariye's compensation thus it couldn't be ceased.

Agada said it was workable for Dariye's compensation to be retained pending the result of the case in court yet the National Assembly Commission had no such powers to stop it.

He stated, "The strategy of the National Assembly is that a man's seat must be pronounced empty before he is never again a congressperson. In view of the most recent data we have, they said he had taken the issue to the Supreme Court.

"All alone, we have no capacity to stop the compensation or recompenses of any congressperson whose situate has not been announced empty. Our expectation was that his compensation would be put on hold pending the result of the case yet do we by any chance have such powers?

"He remains a representative according to the law. It's anything but a matter of profound quality now however a matter of law. The ability to pronounce any seat empty dwells in the Senate President or the Speaker."
