"In addition, what Nungwa served the lawmaking body isn't a request requesting a stay of execution of judgment. It was only an application for an order limiting the lawmaking body from making a move on the issue.

"The application has not been heard by the court. It is just when it is heard and a request made by the court in such manner, that move could be made.

"What they have right now is a movement on notice, which presently can't seem to contend. They can't make any move dependent on that," he said.
